GENERAL

1.1. SCOPE OF APPLICATION

These general terms and conditions of sale (hereinafter ("T&C "), as well as the relevant " Privacy Policy" and"Cookies Policy " are applicable to the website [https://shop.realmadrid.com/] (hereinafter"the Online Store") that LEGENDS HOSPITALITY ESPAÑA S.L.U. ("LEGENDS"), as manager of the Online Store of REAL MADRID C.F., makes available to Internet users, offering the products and services manufactured and distributed under the trademarks owned by REAL MADRID and / oror LEGENDS or under license (hereinafter jointly the"Product(s) " and / oror the"Service(s)").

LEGENDS is domiciled at Paseo de la Castellana 53, 1-b, 28046-Madrid, Spain, and is registered in the Commercial Registry of Madrid and has Tax Identification Number B-88644299.

By accessing and using the Online Store, ordering or or purchasing Products or Services from the Online Store, the customer (hereinafter " Customer" or " you ") declares to have read and understood, and to accept, in their entirety the terms and conditions set out in these T&Cs. These T&Cs can be saved or printed and are accessible from all pages of the Online Store.

These T&Cs may be amended from time to time. The applicable T&Cs are those accepted by the Customer when placing an order, and will be sent to the Customer together with the order confirmation email once accepted, if applicable, in accordance with these T&Cs.

1.2. THE CUSTOMER

The Customer, by placing an order in the Online Store, declares to be aware that we sell Products and Services to non-wholesale Customers acting in their capacity as consumers.

The Customer also represents and warrants that it is (i) legally capable of entering into binding contracts, (ii) over eighteen (18) years of age and (iii) acting in its capacity as a customer.

In general, LEGENDS reserves the right to refuse any order for Products of an unusual nature, in particular, in the case of orders in quantity and/oror for quantities that would reasonably be considered unusual by LEGENDS.

LANGUAGE

The Online Store is accessible in English, Spanish, French, Portuguese, German, Korean, Japanese and Chinese. Versions of the Terms and Conditions will be available in these languages depending on the region.

2. PRODUCTS AND SERVICES, PRICES, ORDER

2.1. PRODUCTS AND SERVICES AND PRICES

The information contained in the Online Store does not constitute an offer to sell, but an invitation to contract.

The Products and Services are described and presented with the accuracy that is reasonably necessary (specifications, material, illustrations, size, composition, etc.). However, if you have any doubts about the Products or Services of your order, especially about the size or of whether the Product or Service fits the characteristics you are looking for, please contact us at "Contact Us" and we will help you.

The prices are those indicated in the Online Store at the time of placing the order, which the Customer will have the option to review prior to order confirmation.

The Customer acknowledges that LEGENDS may revise the prices of the Products and Services of the Online Store from time to time. LEGENDS also reserves the right to change the terms and conditions of all promotional campaigns without notice.

The Customer can check the price actually paid for a Product or Service for previous orders through the confirmation email received, the sales receipt sent to the Customer in the package, or in his customer account if the Customer was registered at the time of placing the order.

The prices are indicated in the currency expressed in the Online Store at the time of the order, which shall be EUR, or any other currency indicated in Section 3 below. The price of the Product or Service shown does not include the costs of delivery of the order (hereinafter " Delivery Costs").

Delivery Costs will be calculated and stated on the order summary page, prior to confirmation and payment by the Customer and shipment of the order.

2.2. ORDER PROCESS

The Customer can select the Products and Services and add them to the shopping cart by clicking on the "Add to Cart" button. The Customer will then be invited to finalize and submit the order by checking one of the payment options or to continue shopping. If the Customer chooses to continue shopping, he/she will be able to check the items added to the basket by clicking on the "Check your Basket" button at the top right of all pages of the Online Store.

Once the Customer is ready to place the order, he/she should click on the "CONFIRM ORDER" button to verify the details of the shopping cart, identify possible data entry errors and correct or delete Product(s) or Services.

After validating the shopping cart to place the order, the Customer must click on one of the "CONFIRM ORDER" options.

LEGENDS is not responsible for the inaccuracy of the information provided by the Customer through the purchase procedure. The customer account will give access to a personal space where customers can track orders and access invoices.

To finalize and place the order, the Customer must confirm the invoice identification data, choose the shipping method, declare that he/she has read and explicitly accepted the T&C and place the order giving access to the secure payment of the order.

An "order" is only considered placed when a Customer submits it through our online checkout process.

LEGENDS will send the Customer a notice when it accepts the Customer's order. LEGENDS' acceptance shall be deemed complete (and the contract shall be deemed executed) and for all purposes effectively communicated to the Customer when LEGENDS sends such notice of acceptance by e-mail to the address provided by the Customer. At that time, the purchase contract shall be formed and become binding on both the Customer and LEGENDS, provided that the order is properly paid for.

LEGENDS reserves the right to refuse or cancel any order before accepting it if the order appears to be abnormal, excessive or violates the provisions of these T&Cs. Some situations that may result in cancellation of a Customer's order or Guest are system or typographical errors, inaccuracies in product information or pricing information or product availability, equity among customers when supplies are limited, or problems identified by LEGENDS credit departments or fraud. LEGENDS may also require verification or additional information before accepting an order.

If an order is partially cancelled, LEGENDS will ship the remaining items in the order to the Customer. LEGENDS will contact Customer if additional information is required to accept such an order. LEGENDS may proceed with the partial order or cancel the order in its entirety if it is unable to contact Customer.

If any Customer's order is cancelled after LEGENDS has processed the Customer's payment, LEGENDS will refund the Customer's payment.

The Customer acknowledges and agrees that once the order is shipped (after confirmation by the Customer), the Customer may not modify it, although the Customer may use its right of withdrawal if applicable in accordance with Section 5 below.

3. PAYMENT

The Products shall be paid for in EUR, except for the countries indicated in the table below.

As of May 28th, all our orders are shipped from Madrid, Spain. Customer shall also bear all mandatory taxes and duties and possible bank charges, which shall be borne by the Customer at all times. Taxes will depend on the customer's country of delivery and, if applicable, VAT or the equivalent local tax will be specified in the order confirmation. Also, the customer may have to pay import duties and taxes levied. These and any additional charges for customs clearance shall be borne by the customer.

If a payment is rejected by the bank, the order will automatically be rejected and LEGENDS will be released from any obligation or liability to the Customer.

LEGENDS delivers the ordered Products to the address indicated by the Customer (the"Delivery Address") according to the delivery option selected by the Customer when placing the order. The Customer shall bear the consequences (late delivery, non-delivery, return of the Products to LEGENDS, additional transportation costs, etc.) arising from any incorrect and/or incomplete delivery information provided by the Customer and/or of its absence at the time of delivery.

For international shipment of products, please note that any manufacturer's warranty may not be valid; manufacturer's service options may not be available; manuals, instructions and safety warnings may not be in the languages of the destination country; products and accompanying materials may not be designed in accordance with the standards, specifications and labeling requirements of the destination country; and products may not conform to the voltage of the destination country (requiring the use of an adapter or converter). The Customer is responsible for ensuring that the goods can be legally imported into the destination country. When an order is placed with LEGENDS, the recipient is the importer of record and must comply with all laws and regulations of the destination country.

LEGENDS will make every effort to deliver the Products to the Customer as soon as possible and in accordance with the delivery option selected by the Customer. LEGENDS is not responsible for delays caused by customs clearance processes of any country or territory.

Please note that due to stock availability and your location within our product distribution network adidas Star Wars edition, your order may take a few days longer than usual to reach you. If you have any questions or clarification, please contact our customer service team where they will be able to assist you.

If an estimated delivery date is not specified prior to order confirmation, delivery shall not exceed thirty (30) calendar days from receipt of order confirmation. If LEGENDS is unable to meet this deadline, we will contact the Customer as soon as possible so that the Customer can agree on a new estimated delivery date or to cancel the order and receive a full refund of the price.

4.2. RECEPTION OF THE PRODUCTS

The risk of loss of the products purchased by a Customer and the responsibility for insuring them passes to such Customer or Guest at the time of delivery of the product in question. Delivery will take place when the Customer or a third party indicated or authorized by the Customer acquires material possession of the products.

At the time of delivery, the Customer shall verify the conformity and condition of the order in the presence of the carrier and report all necessary reservations about apparent defects (missing product, damaged package) and shall be responsible for verifying that the tracking number of the shipment corresponds to the one notified if applicable. The Customer shall also notify LEGENDS of any apparent defects.

If a missing Product or is refused or returned by the Customer in the above circumstances, LEGENDS will refund the Product(s) in question within 20 working days or will reship the damaged Product(s) or missing.

It should be noted that the above provisions do not exclude the Customer's right of withdrawal, as indicated in Section 5.

5. RIGHT OF WITHDRAWAL AND RETURN POLICY

5.1. RIGHT OF WITHDRAWAL

The Customer has the right, without justification, to withdraw his order within fourteen (14) calendar days from the day of receipt of the Products ordered, with the date indicated on the carrier's receipt signed by the Customer attesting to the delivery. If this period of fourteen (14) calendar days expires on a Saturday, Sunday or a holiday, it will be extended until the next business day.

The Customer may exercise its right of withdrawal by notifying its decision and return its Products through the following procedure:

  • or or by returning the Product directly (following the process described below) after having duly completed the withdrawal form, available in the "My Account" section. Please note that the Customer is not required to create a customer account.
  • or by returning to LEGENDS by e-mail or by postal letter an unequivocal statement expressing the intention to withdraw. The Customer may use the withdrawal form available in the"My Account" section, although it is not mandatory. This statement must be sent together with the information relating to the returned Products, as well as the Customer's name, postal address, order number and, if possible, telephone number and e-mail address, to the following address:

  • To return the Product(s), the Customer must return the Product(s) within 14 days From the date of notification of its decision to take back the Product(s), and request a pre-paid shipping label from customer service at [email protected], or the instructions provided by LEGENDS to return the Product(s) free of charge (hereinafter the"Prepaid Label"). Customer shall follow the instructions indicated on the Prepaid Label to be placed on the package. LEGENDS will not reimburse any return shipping costs to the Customer if the Customer has chosen not to use the Prepaid Label provided.

In case of alteration of the Product resulting from handling other than what is necessary to establish the nature and / oror the conformity of the Product, the characteristics or the proper functioning of the Product, LEGENDS reserves the right to refuse the refund or the replacement of the Product. LEGENDS will not make any refund if the Products returned by the Customer do not correspond to the Product(s) ordered or has an origin other than that of the Online Store.

Products cannot be returned to an Official Store of Real Madrid or at any point of sale of Products of Real Madrid.

5.2. RETURN POLICY

The Customer must proceed as follows to return the Product(s):

  • By returning the Product directly (following the process described below) after having duly completed the return form available in the"My Account" section (specifying that the Customer is not required to create a customer account).
  • To return the Product(s), the Customer must do so within 30 days From the date of notification of its decision to return the Product(s). If the Customer has received a defective item, the Customer shall return the Product(s) using a pre-paid shipping label provided by LEGENDS in the package to return the Product(s) free of charge (hereinafter referred to as the"Prepaid Label"). Customer shall follow the instructions indicated on the Prepaid Label to be placed on the package. LEGENDS will not reimburse the cost of return to the Customer if the Customer has chosen not to use the Prepaid Label provided. Customer will return the Product(s) at Customer's expense if the reason for the return is a change of mind.

Products cannot be returned to an Official Store of Real Madrid or at any point of sale of Products of Real Madrid.

5.2. REIMBURSEMENT OF THE ORDER

LEGENDS will refund the returned Products in accordance with the conditions stipulated in section 5.1, as well as the original standard shipping costs paid by the Customer, using the same method originally used by the Customer to pay for the purchase, unless another method has been agreed upon. The refund will be made by LEGENDS within a maximum of fourteen (14) working days From the date on which it was informed of the Consumer's decision to exercise his/her right of withdrawal. Please note that LEGENDS will not refund standard shipping costs if the Customer keeps at least one of the items from the original order and/or if the Customer returns the item later than 14 days from receipt of the order.

Notwithstanding the foregoing, unless LEGENDS has offered to pick up the Product(s) itself, LEGENDS may withhold reimbursement until (i) the date of receipt of the returned Product(s) by LEGENDS or (ii) the date on which Customer has provided proof of shipment of the Product(s) (the date used being the date of the earlier of these events).

6. LIMITATION OF LIABILITY

6.1. OF THE INFORMATION

Customer agrees that LEGENDS assumes no responsibility for the delay, deletion, mis-delivery and/oror failure to store Customer's communications or from its personal settings.

LEGENDS is not responsible for the decisions taken From the information provided in the Online Store nor for the damages caused to the Client or third parties due to actions whose only basis is the information obtained in the Online Store.

6.2 QUALITY OF SERVICE

We reserve the right to refuse service to anyone for any reason and/or discontinue service or any part of it, with or without notice.

The use of this Online Store is subject to all applicable regulations and the Customer is solely responsible for the method of communication used to access the Online Store. Access to the Online Store does not imply any obligation on the part of LEGENDS to monitor the absence of viruses, computer worms or any other malicious software. It is up to the Customer, in any case, the availability of adequate tools for the detection and disinfection of malicious software. LEGENDS is not responsible for any damage to operating systems, software, hardware or any other equipment of Customers or of third parties used during access to the service of the Online Store.

LEGENDS does not grant any guarantee and is not responsible in any case for damages of any nature that may arise from the access or the use of the contents of the Online Store. Among others, but not limited to, LEGENDS is not responsible for the following circumstances:

  • The lack of maintenance and effective operation of the Online Store and / oror of its services or content.
  • Lack of usability and functionality of the Online Store.
  • The existence of viruses, malicious programs or harmful.
  • The reception, collection, storage, dissemination or transmission of content by Customers.
  • The illicit, negligent, fraudulent, contrary to the General Conditions, good faith, generally accepted uses or to public order, use of the Online Store and its contents, by the Customer.

THE CONTENT AND ALL OTHER MATERIALS ON THE ONLINE STORE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. OR TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, LEGENDS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LEGENDS DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. LEGENDS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR OR THE RESULTS OF THE USE OF THE MATERIALS IN THIS SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE. CUSTOMERS (AND NOT LEGENDS) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION OF OR . APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO SUCH CUSTOMERS.

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL LEGENDS BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE ONLINE STORE EVEN IF LEGENDS, OR ONE OF ITS AUTHORIZED REPRESENTATIVES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO ANY SUCH CUSTOMER. IN NO EVENT SHALL LEGENDS' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT [INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE] OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO ACCESS THE ONLINE STORE.

6.3. REGARDING SERVICE AVAILABILITY

Access to the Online Store requires services and supplies of third parties, including transmission through telecommunications networks, whose reliability, quality, continuity and operation do not correspond to LEGENDS. Therefore, the services provided through the Online Store may be suspended, cancelled or blocked, prior or simultaneously with the provision of the Online Store service.

LEGENDS shall not be liable for damages of any kind caused to the Client due to failures or disconnections in telecommunications networks, computer breakdowns or other electronic systems that cause the suspension, cancellation or interruption of the service of the Online Store during a Client's session.

6.4. REGARDING THE CONTENTS AND SERVICES LINKED TO THROUGH THE ONLINE STORE

The Online Store access service includes technical linking devices, directories and even search tools that allow the Customer to access other Internet sites and portals (hereinafter "Linked Sites"). The Online Store includes Linked Sites solely for the convenience of Customers. In these cases, LEGENDS acts as an intermediary service provider in accordance with article 17 of Law 34/2002, of July 12, 2002, on Information Society Services and Electronic Commerce (the "LSSI") and shall only be responsible for the contents and services provided in the Linked Sites to the extent that LEGENDS has actual knowledge of their illegality and has not deactivated the link with due diligence. In the event that the Client considers that there is a Linked Site with illegal content or inappropriate, you may notify LEGENDS in accordance with the procedure and the effects established in Clause 6, without in any case this communication entails the obligation to remove the corresponding link.

In no case, the existence of Linked Sites should presuppose the existence of agreements with the owners or responsible for them, nor any recommendation, promotion or identification of LEGENDS with the representations, contents or services provided. The Linked Sites are provided solely for reference purposes for the convenience of Clients. Although LEGENDS only provides links to web sites that, to the best of its knowledge and belief, comply with applicable law, LEGENDS does not know or approve the contents or services of the Linked Sites and, therefore, is not responsible for any damage caused by the illegality, quality, outdatedness, unavailability, error or ineffectiveness of the contents and / oror services of the Linked Sites, or any other damage that is not directly attributable to LEGENDS.

LEGENDS makes no express or implied warranties with respect to the information, material, products or services that are contained on the Linked Sites or accessible through the Linked Sites. Access to and use of the Linked Sites, including the information, material, products and services on the or linked sites available through the Linked Sites, is solely at the Customer's own risk. LEGENDS explicitly disclaims any responsibility for the accuracy, content or availability of information found on third party sites linked from or to the Online Store. Because some sites employ automated search results or link to sites that contain information that may be considered inappropriate or offensive, LEGENDS is not responsible for the accuracy, copyright compliance, legality or decency of the material contained on third party sites.

LEGENDS cannot guarantee that the user will be satisfied with the products or services purchased from a third party site that links to or from the Online Store, as other sales channels are owned and operated by independent retailers. LEGENDS does not endorse ninguno of the products on these third party sites. LEGENDS makes no representations or warranty as to the security of any information (including but not limited to credit card and other personal information) requested by third parties, and Customer agrees to irrevocably waive any claims against us with respect to such sites. We strongly encourage you to investigate as you deem necessary or appropriate before proceeding with any online or offline transaction with any such third party.

You, the Customer, hereby irrevocably waive any claim against LEGENDS for any cause whatsoever relating to such Linked Sites.

We reserve the right to remove or block access to such content suspected of being unlawful or harmful to the property or rights of third parties, including cases in which we have actual knowledge of it, either by court decision, administrative order or any other means.

7. FORCE MAJEURE

LEGENDS shall not be liable for any failure or to perform any of its obligations caused as a result of a force majeure event, beyond LEGENDS' control, which LEGENDS could not reasonably foresee at the time of entering into the contract with the Customer and the consequences of which LEGENDS cannot reasonably avoid or remedy.

8. LEGAL GUARANTEES. CONFORMITY AND HIDDEN DEFECTS

LEGENDS is obliged to respect the legal warranties regarding the conformity and defects of the Product. LEGENDS shall deliver a product in conformity with the contract (including, but not limited to, with respect to the Product itself, lack of conformity resulting from packaging, assembly instructions or installation when it is its responsibility) and shall be liable for any lack of conformity existing at the time of delivery.

When acting on the basis of the legal guarantee of conformity, the Customer:

  • has a period of two (2) years from the delivery of the Product to claim in relation to the lack of conformity of the Product.
  • you may choose between repair or and replacement of the Product, unless either of these two options is objectively impossible or disproportionate; and
  • is exempted from providing proof of the existence of the lack of conformity of the Product during this period.

LEGENDS shall only be responsible for the Products, i.e. the Products purchased from the Online Store.

Please note that the legal and commercial warranties do not cover damage or defects resulting from an external cause (accident, blow, etc.) or improper use or other than that indicated in the Product description by the Customer.

10. APPLICABLE LAW/CONTROVERSIES

These T&Cs are governed in each of their points by Spanish law for the resolution of any dispute related to the T&Cs or with the Online Store. By accessing the Online Store, each User agrees that any legal action or in equity, arising out of or is related to these terms, shall be brought only in the Spanish courts, and each Customer hereby consents and submits to the personal jurisdiction of such courts for the purpose of litigating any such action. If any provision of these terms and conditions shall be unlawful, void or, for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions. LEGENDS' failure to exercise or enforce any right or provision of these T&Cs shall not constitute a waiver of such right or provision, or any other right. These T&Cs set forth the entire agreement between us relating to their subject matter and may only be modified by a writing signed by both parties.
